Successful prediction six years ago: China has no choice to participate in the TPP
Editor's Note: A week ago, on September 16, 2021, China applied to join the Comprehensive and Progressive Trans-Pacific Partnership Agreement (CPTPP). The predecessor of this agreement is the Trans Pacific Partnership Agreement, which was negotiated by the United States, Japan, Australia, several ASEAN and Latin American countries on October 5, 2015. At that time, some people called it "Economic NATO". The United States withdrew in 2017. In the same year, Japan and Vietnam announced that they would continue to promote TPP without the United States, and renamed it "Comprehensive and Progressive TPP" (CPTPP). Digital Trade: The United States Ignores Multilateralism and Takes the Lead in Engaging in Small Circles
In January 2019, 76 WTO members, including China, issued a joint statement to officially launch e-commerce negotiations. This is a spontaneous discussion and negotiation among some WTO members, not a multilateral negotiation initiated by the WTO, nor a plurilateral negotiation under the WTO framework. According to the proposals of all parties, the negotiations mainly focus on the following issues: trade facilitation, such as electronic signature, electronic invoice and payment, paperless trade, customs clearance, etc; Cross-border data flows, data storage locations, the Internet, and data access; Consumer protection, privacy protection, and business trust (source code, etc.); Transparency, network security, regulation; Product updates and tariff enforcement for the Annex to the WTO Information Technology Agreement. During the negotiations, the main positions of developed countries in the United States, Europe, and Japan are summarized as follows: In terms of cross-border data flow and data localization, the United States, Europe, and Japan advocate prohibiting localization requirements and supporting the free flow of data; Expand products under the Information Technology Agreement and prohibit the application of non national treatment and substantive market access restrictions in computer and telecommunications services; Strengthen the intellectual property protection of source code, and one party shall not require the transfer or use of software source code owned by the other party; The exemption order for electronic transmission shall be permanent, and the exemption scope shall include two aspects: transmission content and electronic transmission services; Protect privacy and advocate government data disclosure.

Years pass by, and old events unfold (Series 8)
During the more than a year of "demining" by the two kings of the Chinese delegation, the work of the China Working Group has made little progress. Obviously, the entry of both sides of the Taiwan Strait into the General Agreement on Tariffs and Trade is actually bound together. Without resolving the Taiwan issue, China's negotiations will be difficult to proceed. However, the main contracting parties in the West, led by the United States, the Secretariat of the General Agreement, and the Chairman of the China Working Group, Gillard, are also very clear about a political red line, that is, the Taiwan issue cannot be bypassed by China and cannot be negotiated with the Chinese government. Without the consent of the Chinese government, the Taiwan issue is exempt from negotiations.

Time flies, and the old story unfolds (Series 6)
Carrots and sticks are a consistent practice of the United States in international trade exchanges. Especially for non market economy countries, the US trade policy has always been political. After World War II, American law stipulated that the Communist Party countries were not given the most favored nation treatment, but they were treated differently according to their affinity, likes, and dislikes. The most favored nation treatment is the cornerstone of the General Agreement on Tariffs and Trade (GATT). Article 1 of the GATT clearly stipulates that members must unconditionally grant each other the most favored nation treatment. When Romania and Hungary joined the General Agreement in the same year, the above provisions of United States domestic law directly conflict with the General Agreement. Therefore, the United States chose not to apply to each other in the General Agreement with these two Eastern European countries.

Trade and Environment: WTO Agreement on Environmental Products is expected to restart negotiations
The global environmental degradation caused by climate and environmental change has become a common problem faced by all mankind. Among them, the environmental impact of the cross-border flow of goods and services, that is, international trade, has also been the focus of the multilateral trading system. As early as 35 years ago, in the Uruguay Round negotiations initiated by the then General Agreement on Tariffs and Trade, the contracting parties began negotiations on trade and environment issues and made the "Decision on Trade and Environment". The WTO, which was later established to implement this decision, established the Environment and Trade Commission in the WTO, which is specifically responsible for discussing environmental and trade issues. Since the establishment of the WTO, in the absence of multilateral rules, some developed countries have deliberated and prepared to implement measures in their domestic laws to raise tariffs on products imported from countries with low environmental standards. For example, the EU is about to implement a "carbon tariff" on imported products. Another example is the Trump government's assertion that products produced without meeting environmental standards are considered subsidies and can be subject to a countervailing tax. Without a fair and equitable international trade rule, the environmental policies of developed countries are prone to discrimination against the trade activities of other countries, especially developing countries. For decades, WTO members have been seeking a fair and equitable balance between trade and the environment in order to achieve the goal set out in the Agreement on the Establishment of the World Trade Organization, namely, "to seek measures that not only protect and maintain the environment, but also adapt to the needs of their respective economic development levels."

A Legal Person and the Past of WTO (2)
The restoration of seats was a standard action taken by the Chinese government to return to international organizations in the 1960s and 1970s. As a legal person, it is not difficult to understand this. In 1949, there was a change of government in China, but as a country, the main body of international law has not changed. What has changed is the government that acts on behalf of China internationally. The new government will inherit and continue the former government's actions and rights and obligations in the international community, and its seat in international organizations will naturally be inherited by the new government.

Gao Peng assisted the Ministry of Commerce of China in obtaining the final victory of China's first enforcement appeal(fastener)in the WTO
On January 18,2016,the head of the Department of Treaty and Law of the Ministry of Commerce issued a statement announcing that China had won the final victory in the implementation of the anti-dumping measures case against EU fasteners(Case No.DS397).This 100-page appellate body report supports almost all of China's appeals and refutes the EU's appeals,which is a complete victory for China.At this point,the WTO dispute procedure on fasteners between China and the EU,which began in 2009,has basically come to an end.

Gao Peng assisted the Ministry of Commerce of China in winning China's first enforcement lawsuit (fastener) in the WTO
On August 7, 2015, the head of the Department of Treaty and Law of the Ministry of Commerce issued a statement announcing that China had won the case against the EU on anti-dumping measures against fasteners (Case No. DS397) during the expert group stage of the enforcement lawsuit. This is the first time that China has won the execution of a lawsuit in the WTO. Based on the victory of the original trial, the enforcement action once again determined that the EU had not fully implemented the WTO Dispute Resolution Body's ruling.

Lawyer Gao Peng and Wang Lei were invited to participate in the dialogue program on the 10th anniversary of China's accession to the WTO on CCTV English Channel
December 11,2011 is the tenth anniversary of China's accession to the WTO.CCTV invited Wang Lei,a lawyer from our institute,and another American economist to interview them,and broadcast them on the English Channel Dialogue program that night.As a negotiator at that time,Lawyer Wang pointed out that the decade of China's accession to the WTO has been the fastest and most positive one in recent decades.During this decade,China's national strength has increased,people's living standards have improved,trade strength has greatly increased,and the rule of law has been more respected,all of which are significant progress;At the same time,China still has a long way to go to make the country prosperous and the people strong.Regarding trade protectionism,Lawyer Wang believes that China's trade growth mainly stems from comparative advantage,rather than so-called unfair competition.Some countries do not recognize this comparative advantage,but instead resort to protectionism unilaterally,which not only hinders trade with China,but also fails to solve the difficulties of domestic industries.

Lawyer Gao Peng and Wang Lei won the WTO appeal case on behalf of the Ministry of Commerce
After the World Trade Organization(WTO)Dispute Resolution Mechanism Expert Group released its ruling report on"China v.EU Fastener Anti dumping Measures Case"on December 3,2010,both the EU and China filed an appeal to the WTO Appellate Body.On July 15,2011,the Appellate Body published its report and upheld the expert group's ruling that the provisions on"individual tax rates"in the EU's Basic Regulations on Anti dumping do not comply with WTO rules;At the same time,the Appellate Body overturned the ruling of the Expert Group and found that the EU violated WTO rules in defining domestic industries and fairly comparing normal prices and export prices in the EU anti-dumping investigation against carbon steel fasteners in China.At this point,China's first case against the EU in the WTO ended in a complete victory for China.

On December 3rd,the Expert Group of the World Trade Organization(WTO)Dispute Settlement Mechanism released its ruling report on the"China v.EU Fastener Anti dumping Measures Case"in Geneva,Switzerland.The ruling of the expert group includes two aspects:first,the provisions on"separate tax rates"in the EU's"Basic Regulations on Anti dumping"do not comply with WTO rules;At the same time,the anti-dumping measures taken by the European Union against Chinese carbon steel fasteners also violate WTO rules.This is the first case in which China has sued the EU to the WTO,and China has achieved substantial victory in this lawsuit.

Gaopeng 2009 Annual Work Summary Meeting Held in Yangzhou
On December 30, 2009, the "2009 Annual Summary Conference of Beijing Gaopeng Law Firm" was solemnly held in the conference hall of Yangzhou Hotel. Tire Special Protection Case: Gaopeng Agency Acting for China's Ministry of Commerce Wins in India

Lawyer Gao Peng Wins the Only Individual Tax Rate and Minimum Tax Rate for Enterprises in China
On October 6,2009,after 15 months of EU anti-dumping investigation on seamless steel pipes in China,the final decision was issued.The national uniform tax rate for responding companies in China is 27.2%,while the tax rate for non responding companies is 39.2%.Shandong Luxing Steel Pipe Co.,Ltd.,represented by Gao Peng,became the only company in the country that received a separate tax rate among the responding companies,with a tax rate of 17.7%,nearly 10%lower than the national tax rate.

Anti dumping in 2006: China remains the "protagonist"

Gaopeng lawyers won anti-dumping cases for notable Chinese companies-Gaopeng & Partners
Gaopeng trade lawyers represented a notable Chinese company,Beijing Matsushita Color CRT Co.,Ltd.(BMCC),in the anti-dumping investigation initiated by the EU against Chinese TV tubes.The European Commission made the final determination last November that BMCC is granted market economic status and its dumping margin is zero.Based on the lack of causation between dumping and injury,the Commission decided to terminate the investigation.

Beijing Gaopeng Law Firm reached a price commitment on behalf of a Korean company in the anti-dumping case of stainless steel billets, hot rolled stainless steel plates, and coils
Recently,the Ministry of Commerce of China issued a final decision on anti-dumping cases against stainless steel billets and hot rolled stainless steel plates/coils imported from the European Union,Japan,South Korea,and Indonesia.Gaopeng represented POSCO,a South Korean steel company,and ultimately obtained a satisfactory result of the price commitment.It is also the only enterprise to obtain a price commitment in this anti-dumping investigation.Although many companies have submitted price commitment applications,the Ministry of Commerce of China has only accepted applications from customers represented by Gaopeng.
