In the field of international trade and WTO disputes, Dr. QIAN has represented the Government of China, exporting producers and Chambers of Commerce in a number of landmark trade investigations, such as the EU’s first anti-subsidy proceeding against China (Coated Fine Paper), China’s first WTO dispute against EU (DS397) and US first 337 investigation against steel products from China (investigation No. 337-TA-1002).
In the EU Fasteners dispute (DS397), Dr. Qian acted as the legal counsel to MOFCOM, and the historic issue of “individual treatment” was settled in that case. As the result, EU amended the original Article 9.5 of its Basic Anti-Dumping Regulation on 3 September 2012, and the EU anti-dumping measures against fasteners from China was withdrawn on 27 February 2016.
With regard to US 337 Section, in the investigation against steel products from China (investigation No. 337-Ta-1002), Dr. Qian represented a major Chinese steel enterprise as respondent and won all the claims in that case. Likewise, in the 337 investigation against High-Potency Sweeteners (337-TA-1030), she represented the biggest Chinese exporter and won the case.
Dr. QIAN used to work for the Delegation of the European Commission to China for treaty negotiation and Science & Technology cooperation programs. Since February 2009, she worked as a lawyer in providing legal services of WTO and international trade, US Section 337 investigations, intellectual property and export control.

Removal strategy of Chinese enterprises in the list of Entity List related to Xinjiang
On June 12, 2023, the U.S. Department of Homeland security added a number of Chinese enterprises to the Entity List of the Xinjiang related Act (UFLPA). According to the Notice on New Entities in the Entity List of the Uighur Forced Labor Prevention Act (the "Notice") issued by the United States Department of Homeland Security on August 5, 2022, [1] enterprises listed as border related entities can apply to the U.S. government for removal. In early January 2022, the United States Customs and Border Protection (hereinafter referred to as "the United States Customs") detained a batch of Chinese dates at the port of Oakland, California, under the Xinjiang Related Act, on the grounds that these dates were produced in Xinjiang and the packaging was printed with the "Xinjiang Construction Corps" icon [1]. The Impact of the New Policy on Steel Export on Anti dumping
On August 1, 2021, the State Council raised the export tariffs on ferrochrome and high-purity pig iron products to 40% and 20% respectively, and canceled the export tax rebates for 23 types of steel products such as cold rolled and oriented silicon steel. As early as May 1, 2021, China had raised the export tariffs on products such as ferrosilicon, ferrochromium, and high-purity pig iron to 25%, 20%, and 15%, respectively, while canceling the export tax rebates for 146 types of steel products, including hot-rolled plates, tubes, and so on.

A Preliminary Study on EU Carbon Tariff Policy
"Carbon tariffs refer to tariffs imposed by importing countries on high energy consumption imported products such as cement, steel, aluminum, oil refining, paper making, glass, chemicals, and fertilizers, with the aim of raising the import costs of the aforementioned foreign products, in order to avoid the domestic industry of the importing country losing its price advantage due to the implementation of higher environmental standards.". The rationality and legitimacy of this policy have always been highly controversial. Currently, no country has officially imposed a carbon tariff, but the EU has proposed increasingly specific carbon tariff policy goals and plans, and is expected to start implementing them in 2023. The EU's approach is likely to be emulated by other developed countries, which will have a systematic impact on the global economic and trade situation, especially on China's exports of high energy consumption products such as steel and chemicals.

Lawyer Gao Peng Strives for the National Minimum Tax Rate in the Anti dumping Investigation of Galvanized Steel in South Africa
On October 12, 2022, the South African International Trade Administration Commission (ITAC) (on behalf of the Southern African Union - SACU, including five countries, South Africa, Botswana, Namibia, Lesotho and Eswatini) issued a notice to launch an anti-dumping investigation on galvanized steel products imported from China. The South African tax number of the product in question is 72104910. The international trade law team of Gaopeng Law Firm represented Shandong Tongsheng Composite Materials Co., Ltd. Beijing Gaopeng Law Firm reached a price commitment on behalf of a Korean company in the anti-dumping case of stainless steel billets, hot rolled stainless steel plates, and coils
Recently,the Ministry of Commerce of China issued a final decision on anti-dumping cases against stainless steel billets and hot rolled stainless steel plates/coils imported from the European Union,Japan,South Korea,and Indonesia.Gaopeng represented POSCO,a South Korean steel company,and ultimately obtained a satisfactory result of the price commitment.It is also the only enterprise to obtain a price commitment in this anti-dumping investigation.Although many companies have submitted price commitment applications,the Ministry of Commerce of China has only accepted applications from customers represented by Gaopeng.

On August 8,2019,the Eurasian Economic Union released its final findings on the safeguard investigation of imported flat rolled steel,adopting a one-year quota form safeguard measure for imported hot rolled steel,imposing a 20%safeguard tariff on imported hot rolled steel that exceeds the quota,but granting exemptions for related products exported by Chinese enterprises.

Win in America! Gaopeng Represented Chinese Steel Enterprises for the First Time in Responding to the US 337 Investigation, Fully Winning the Case
On March 19,2018,the United States International Trade Commission(ITC)issued an announcement,deciding to terminate the antitrust investigation of the carbon steel and alloy steel 337 case.ITC ruled that the plaintiff had to prove that it had suffered damage due to the defendant's monopolistic behavior,and because the plaintiff could not prove it,it was not eligible for litigation.So far,after two years,China has won all three lawsuits in the Steel 337 case,namely,antitrust,theft of trade secrets,and fictitious origin.The rarity of legal charges,the high amount of money involved,the wide range of products,and the number of accused steel companies in this investigation are unprecedented in the 337 US investigation cases encountered in China.This case will have a significant impact as a 337 precedent.In the future,the United States will face great difficulties if it wants to file antitrust charges under the 337 procedure.In the current situation where the United States is trying to jointly block Chinese steel through a 232 investigation with other countries,this time,Chinese enterprises have won a comprehensive victory in the domestic legal proceedings in the United States,which is heartening.
