Gaopeng acts as an agent for a domestic A-share pharmaceutical listed company and obtains the lowest tax rate in China in the anti-dumping investigation of gloves from China in Brazil

2024 10/28

This tax rate is only higher than the tax rate for mandatory litigation companies in Thailand and significantly lower than the tax rate for mandatory litigation companies in Malaysia, making it the second lowest in the world.

In this case, the clients represented by Gao Peng involve many affiliated enterprises, including the main body of the listed company, three production subsidiaries, and two Hong Kong trading companies. The trade process is complex, time is tight, workload is large, and on-site verification time is long. Many partners and lawyers from Gaopeng International Trade participated in the defense of this case. The leading partner in this case is Senior Partner Lawyer Jiang Liyong, and the lead lawyer is Lawyer Sun Zhen. International trade consultants Dai Ke, Lawyer Qin Yi, and Lawyer Yao Mingyue all participated in the entire litigation process of this case. In addition, Senior Partner Lawyer Li Jun also made contributions to this case.

The Gao Peng legal team made every effort to actively defend the classification of the investigated products, the calculation of export prices and normal values in the dumping margin, the calculation of damage margin, the exclusion of some investigated products, whether the damage was established, and many other aspects, while fully submitting the answer sheet and responding to the questions of the investigating authority. After the disclosure and announcement before the final ruling, they still argued reasonably. In the end, the final ruling tax rate decreased by 0.4 US dollars per thousand compared to the final ruling disclosure tax rate.

In this case, Gaopeng was its client, and as the main Chinese forced respondent in the anti-dumping investigation of Brazilian gloves, it fought for a lower tax rate, allowing Gaopeng's client and related Chinese enterprises to continue to develop and explore the local glove market in Brazil. In the current period of increasing international trade and geopolitical tensions in some regions, obtaining the survey results is truly hard won.

At this point, following successfully representing Brazil in responding to anti-dumping investigations into Chinese car tires, truck and bus tires, daily ceramics, nylon materials, etc., Lawyer Gao Peng has added another successful case to his record of representing Brazil in anti-dumping cases.
