Gao Peng, on behalf of large domestic pharmaceutical companies, obtained a harmless conclusion in India's anti dumping investigation of metronidazole against China
The Indian Ministry of Commerce and Industry recently issued a final ruling on India's anti-dumping investigation against metronidazole against China. The announcement of no harm closure and termination of anti-dumping investigations ultimately resulted in a comprehensive victory for Chinese enterprises. In the series of anti-dumping final rulings released by the Indian government from the end of September to early October, the metronidazole case represented by Gaopeng Law Firm was almost the only case that was ruled harmless and terminated. A team composed of senior partner lawyer Jiang Liyong, as well as lawyers Sun Zhen and Zhang Bo, provided legal services for the company in response to the Indian anti-dumping investigation.
Gaopeng Law participated in the investigation of this case on behalf of a Chinese pharmaceutical listed company. In addition, Gao Peng, along with our Indian lawyer, pointed out that there are loopholes in the applicant's qualifications, damages, causal relationships, and other aspects of this case.
The clients represented by Gaopeng participated in all procedures such as anti-dumping response and defense of damages, and cooperated with on-site inspections remotely. In addition, the defense opinions regarding damages are still actively submitted after the final determination disclosure.
Finally, in the final determination, the investigating authority recognized our point of view, determined that India's domestic industry had not suffered damage, and announced the termination of this anti-dumping investigation against metronidazole.
In this case, Gaopeng customer, as the only Chinese respondent to the Indian metronidazole anti-dumping investigation, has strived for a no harm ruling and successfully concluded the investigation, allowing the relevant Chinese enterprises to continue developing and expanding into the local market in India. In the current era of increasing international trade and geopolitical tensions, it is indeed not easy to obtain the results of the investigation without harm.
