On the afternoon of March 28, 2025, the Enforcement Committee of Zhengzhou Bar Association visited Beijing Gaopeng (Zhengzhou) Law Firm and held a seminar on the theme of "Case Handling Path for the Former Legal Representative of the Company to Lift the 'Height Limit'". The event was fully organized by Beijing Gaopeng (Zhengzhou) Law Firm and came to a successful conclusion.
Meeting venue
The event was hosted by Li Yikun, an intern lawyer at Beijing Gaopeng (Zhengzhou) Law Firm, and was held in both offline and online live streaming formats. The second agenda of the meeting was presented by Lawyer Qiao Pengfei, Director of the Legal Affairs Department of Beijing Gaopeng (Zhengzhou) Law Firm, with the theme of "The Case Path for the Former Legal Representative of the Company to Lift the 'Height Limit'". Lawyer Qiao Pengfei, as an executive member of the Zhengzhou Bar Association's Enforcement Committee, has conducted in-depth analysis from multiple perspectives, including the applicant for enforcement, the executed enterprise, and the enforcement agency, on issues related to the application for lifting the "height limit" case by the original legal representative, evidence issues, and the identification of "non directly responsible personnel who do not affect debt performance". Based on multiple practical cases he has undertaken, he has analyzed these issues for everyone.
Qiao Pengfei
In the practical issue discussion session, Lawyer Qiao Pengfei mentioned that due to the limited provisions within the existing legal framework regarding the application of the original legal representative of a company to lift the "height limit", there are many inconsistencies in the handling procedures, review standards, and closing documents of such cases by local authorities in current judicial practice. These issues include whether there is a written decision or deliberation record within the handling authority when deciding to revoke the original legal representative's "height limit" measure, how the applicant for enforcement should be relieved and what procedures should be applied when they do not comply with the handling authority's decision to revoke the "height limit". Representatives of the mandatory enforcement committee attending the meeting expressed their opinions and conducted in-depth discussions on the above-mentioned issues.

At the end of the meeting, Liu Bin, Executive Director and Director of the Enforcement Committee of Zhengzhou Lawyers Association, gave a concluding speech on the event. Director Liu Bin expressed his gratitude to Lawyer Qiao Pengfei for his thematic sharing and Gao Peng for his outstanding performance in Zhengzhou.
