Lawyer Li Kejun, a partner of Gaopeng in Shenzhen, gave an interview to a reporter from Guangzhou Daily regarding the Law on the Promotion of the Private Economy (Second Draft for Deliberation)

Recently,the"Law on the Promotion of the Private Economy(Second Draft for Deliberation)"was submitted to the 14th meeting of the Standing Committee of the 14th National People's Congress for deliberation,which has attracted widespread attention from all sectors of society.As a draft law aiming to provide a more equal market environment for the private economy,its newly added provisions are highly anticipated.A reporter from Guangzhou Daily interviewed Lawyer Li Kejun,a partner of Gaopeng(Shenzhen)Law Firm in Beijing,to provide us with an in-depth interpretation of the highlights and significance of the second draft for deliberation.
In the interview,Lawyer Li Kejun pointed out that the core highlight of the second draft for deliberation is to provide private enterprises with more equal market access opportunities and fairer policy treatment.He emphasized that the draft clearly states that"private enterprises can enter the fields outside the negative list for access",which will greatly expand the market space of private enterprises.In addition,the draft also stipulates that"government departments cannot formulate or implement discriminatory policy measures against private enterprises",which will further guarantee the equal status of private enterprises in public resource transactions,financial services and other fields.
Lawyer Li Kejun particularly mentioned that the provision of"no charges or fines without basis"in the draft is highly targeted and enforceable.He explained that the implementation of this clause will enable private enterprises to legally refuse or even file lawsuits when facing charges or fines without legal basis,as well as when facing apportionment,and also provide a clear basis for the court's judgment.
The promotion of the formulation of the"Law on the Promotion of the Private Economy"reflects the state's emphasis and support for the private economy.Lawyer Li Kejun said:"The promulgation of this law will build a solid legal guarantee for private enterprises and promote the vigorous development of the private economy in a fairer and more transparent environment."
