On June 18, 2023, the "article by article discussion on the Guiding Opinions on Punishing Cyber Violence (Draft)" held by the National Legal Aid Institute of China University of Political Science and Law was held in Xiangshan Hotel. Lawyer Dong Xiaohua, Senior Partner of Gaopeng Law Firm, was invited to participate in the seminar.


On June 9, 2023, the Supreme People's Court, the Supreme People's Procuratorate, and the Ministry of Public Security jointly issued the Guiding Opinions on Punishing Cyber Violence Crimes in accordance with the Law (Draft for Comments), which clarifies the specific acts of cyber violence, Legal remedy, and other aspects, and proposes targeted solutions to the long-standing difficulties in filing and obtaining evidence in cyber violence cases, causing widespread concern in the society.



The seminar is divided into several stages: keynote speeches, discussion of the "Draft for Soliciting Opinions" item by item, and summary speeches. During the discussion, scholars, experts, lawyers and other attendees combined the relevant legal documents on punishing online violence that have been introduced by the country in recent years, and combined with cases such as the "Hangzhou Cyber Defamation Case", "Wuhan Primary School Mom Falling from a Building Incident", and "Pink Hair Girl Suicide Incident", from the specific behaviors of online violence in the "Draft for Soliciting Opinions", the situations of online violence that should be heavily punished Opinions or suggestions were put forward on the connection with criminal law provisions, and areas for refinement and improvement in the "Draft for Soliciting Opinions" were also proposed. Lawyer Dong Xiaohua interpreted the highlights and significance of the "Draft for Soliciting Opinions" from the perspectives of the boundary between online violence and legal behavior, as well as how public security organs can assist in obtaining evidence, and provided targeted suggestions.
