On the afternoon of May 22,2018,the"71st Training Course for Practitioners Applying for Lawyers in Beijing-Commercial Arbitration Practice Training"simulated arbitration tribunal was held in the multi-function hall on the fifth floor of the China International Economic and Trade Arbitration Commission(hereinafter referred to as the"CIETAC"),with approximately 150 practicing lawyers participating in the 71st training course.

Lawyer Zhang Zheng,founding partner of Beijing Gaopeng Law Firm,accepted the appointment of the Director of the Trade Arbitration Commission as an arbitrator,and jointly formed a mock arbitration tribunal with Mr.Xia Jun,senior partner of Beijing Yihe Zhonghong Law Firm,and Mr.Li Haifeng,consultant of Beijing Fenxun Law Firm.The three arbitrators are all senior arbitrators of the China International Trade Arbitration Commission and have rich experience in handling company affairs disputes.

In this issue,the simulated arbitration tribunal selected a capital increase agreement dispute case adapted from the real case of the China International Trade Arbitration Commission,including the current hot gambling elements.During the court hearing,the arbitration tribunal guided the representatives of both parties to state the arbitration request and defense opinions,cross-examined the evidence,conducted a full debate around factual and legal issues,and made a final statement.In addition,the arbitration tribunal also demonstrated to the entire audience the pre court and post court collegial sessions that are not disclosed to the parties during the formal trial,demonstrating the arbitrators'clear grasp of the context and focus of the case before and after the trial.

After the trial,Lawyer Zhang Zheng provided targeted comments and guidance on the performance of the agents of both parties in the simulated arbitration tribunal based on the merits of the case and his own experience in arbitration work.Lawyer Zhang Zheng also proposed the concept of"two services"for arbitration,that is,"lawyers serve the arbitration tribunal,and the arbitration tribunal serves the parties.".Lawyer Zhang hopes that in the future,students,as legal agents,should consciously pay attention to fully cooperating with the arbitration tribunal in the substantive and procedural aspects of arbitration cases,so as to be more conducive to the arbitration tribunal's balancing and handling of the interests of the parties and making fair and efficient judgments.

This simulated arbitration tribunal training activity received unanimous praise from the vast number of participants on the spot,and was successfully concluded with warm applause.
