On the morning of March 16,2018,the Expert Seminar on Frontier Legal Issues in the Innovation of Commercial Arbitration Rules,organized by the China Arbitration Law Research Association,was held on the 16th floor of the International Chamber of Commerce Building.This seminar was chaired by Yu Min,Deputy Secretary General of the Secretariat Bureau of the China National Commission of the International Chamber of Commerce,and invited Chen Jian,Secretary General of the China Arbitration Law Research Association,Liu Jingdong,Director of the International Economic Law Office of the Institute of International Law of the Chinese Academy of Social Sciences,Shen Hongyu,Judge of the Fourth Civil Court of the Supreme People's Court,Li Hu,Secretary General and Deputy Secretary General of the China International Economic and Trade Commission to deliver speeches.In addition,more than 60 experts from enterprises,law firms,and arbitration institutions were invited to attend the seminar.Lawyer Zhang Zheng,senior partner of Beijing Gaopeng Law Firm,was invited to attend the meeting and give a speech.

This seminar took the ruling of the Shanghai First Intermediate People's Court on the non recognition and enforcement of the arbitration award made by the Singapore International Arbitration Center in August 2017 in the case between Noble Corporation of Singapore and Shanghai Xintai International Trade Co.,Ltd.as a case study.The discussion focused on which of the arbitration clauses specified in the contract and the applicable arbitration rules had priority.The experts participating in the seminar held a heated discussion on this issue.Lawyer Zhang Zheng expressed his opinion on this hot case and predicted that in the future,the boundaries,conflicts,and respective authorities between party autonomy,which is the legal basis for arbitration,and the rigid handling stipulated in the rules of arbitration institutions will lead to a competition in the details of the rules of various arbitration institutions.The rules of the institutions cannot only consider attracting parties to participate in arbitration,and the rigid"preventive"measures should also be supplemented in a timely manner,In case the case is revoked or not enforced.Lawyer Zhang Zheng's speech was unanimously recognized by the experts attending the meeting.
