In particular, the situation of "serious violation of the rules and regulations of the employing unit" in Article 39 of the Labor Contract Law of the Labour Contract Law of the People's Republic of China is analyzed in depth. From the perspective of lawyers providing perennial legal counsel to enterprises, it is suggested that the provisions in the rules and regulations should be quantified and clearly standardized as far as possible, and those that cannot be quantified should be objectively presented as far as possible from the perspective of evidence to avoid differences or no basis for implementation in case of disputes.
